It is not a crime for Iraqis to fight against the US in Iraq. It is a crime for the US to capture or kill them.
If these Iraqis really were fighting against the US, then the US would have the right to capture and hold them. It is a crime for an Iraqi to fight the US in Iraq, and it is not a crime for the US to capture those who do.

Hundreds of other Iraqis have been seized since the war often, according to critics, on flimsy suspicion and held for long periods without charge, usually without their families knowing for weeks where they are.

The US will want the US to stay in Iraq, the US will choose to stay in Iraq, and the US will continue to be the master of Iraq after June 2004. The US will choose some Iraqis to "invite" the US to stay in Iraq.
As of July 2004, Iraq will have an independent government that will choose to invite the US to stay.
